Windhorst Says SAFE-T Act Ruling Consistent with Illinois Constitution

METROPOLIS – State Rep. Patrick Windhorst (R-Metropolis) issued a statement following a Kankakee County judge’s ruling on Wednesday night that the provision eliminating cash bail contained in the controversial SAFE-T Act is unconstitutional.

“Even before the original SAFE-T Act passed by the slimmest margin in the final minutes of the lame duck Session of the previous General Assembly, I said ending cash bail is unconstitutional.  This ruling by a Kankakee County judge has affirmed that opinion and validated many of the arguments made by myself and others over the last two years. While there will no doubt be an appeal and more rulings to come, I want to thank the state’s attorneys and sheriffs of both parties who brought this court challenge.  Cash bail should remain the law in Illinois.”
